But Marietta attorney Tom Cauthorn, a former Superior Court judge who now represents the Downtown Marietta Development Authority, said he does not anticipate a legal appeal of Grubbs’ decision. He also believes the ruling will not deter Kroger and the project’s developers, saying he expects the parties to find a way to move forward with construction.

“I don’t think anybody’s going to appeal anything, because they’ve got a commercial project they want to go forward with, and it would be an unusual developer who would want to submit the fate of their project to the uncertain schedule of an appeal,” Cauthorn said. “The developers know where they are right now, they know what the economy is, they know what the numbers are in regard to what part of Cobb County that they’re putting this development in, they’ve done a complete analysis of it and that analysis depends on things being done within a commercially reasonable period of time after the analysis, not in a year or two or three down the road.”
